If approved National Development Plan until 2022-2026, As was presented yesterday before the Congress of the Republic and the country in general, President Gustavo Petro will have six months to reorganize the companies and entities in which the Nation has a stake, regardless of the sector in which they operate. The foregoing is part of the extraordinary powers that would be granted to the president if the Legislature, after the pertinent discussions, approves said plan.

The document specifies that it would give the President extraordinary powers for six months to create, split, merge, suppress, integrate or modify the legal nature of the entities of the Executive Branch; make the necessary budget modifications to finance the necessary operating and investment expenses; o regulate the alternative uses of the coca plant and cannabis for medicinal, therapeutic and scientific purposes.

The Plan also talks about creating the National Council of Cultural and Creative Economies, the RNational Emissions Reduction Registry and Removal of Greenhouse Gases, the National Council to Combat Deforestation and other environmental crimes or the National System for the Search for Persons Missing in the context of and due to the armed conflict.

Article 298 of the mentioned plan specifies that these extraordinary powers that would be granted to the president would also allow him to «identify, modify and determine the objectives and the organic structure of the entities resulting from the creations, mergers or divisions and those of those entities to which the functions of those suppressed, divided, merged or transformed».

But also, capitalize the companies that are createdmerge, split or integrate, and establish the conditions for the Nation’s capital contribution.

The President may also, using these powers, create, split, merge, delete or modify the legal nature of account funds, which are a tool for the «administration of public resources, with or without legal status» and whose «legal representative is the head of the entity to which it is attached, which works with the plant of the ministry or department».
